OSHA… What’s on Tap for 2016???

With 2016 being the last year of the current administration, we are likely to see some regulatory action. According to OSHA’s published agenda here are some of the things we may see… FINAL RULES The Final Rule on reducing the Permissible Exposure Limit (PEL) of Crystalline Silica is expected to be released by February 2016. The Final Rule on the electronic maintenance and submittal of OSHA Injury & Illness Logs is scheduled to be released by March 2016. The Final Rule for updating the 1910 Subpart D standard on Walking Working Surfaces is supposed to be released by April 2016. PROPOSED RULES OSHA is talking about making several modifications to their Crane Standard (1926 Subpart CC) to correct inaccuracies within the standard. OSHA is planning on updating their Permissible Exposure Limit (PEL) on Beryllium. OSHA is revising their current protocol on respirator fit testing. Spreading Love and Joy during the Christmas season

Sheltering Wings is a Non-Profit organization that assists women and their families who are in need of shelter and discretion. We were able to Adopt A Family, to ensure their holiday season was fulfilling and cheerful. OSHA to Enhance Pursuit of Criminal Liability

OSHA currently has the ability to pursue criminal liability against companies and managers who are involved with a work-related fatality resulting in a “Willful” violation. The maximum penalty if convicted would be up to $500K for the company, $250K for executives, and 6-months in prison. Such convictions are currently classified as “Misdemeanors”. On December 17, 2015 the Department of Labor announced an initiative to partner with the Department of Justice to seek additional criminal liability for lying during OSHA inspections, making false statements in government documents, obstructing justice, and tampering with witnesses. Convictions under any of these charges would result in elevated penalty amounts, possibly up to 20-years in prison, and they would be classified as a “Felony”. This movement obviously underscores the importance of being honest with OSHA, especially during investigations.

Space Heater Safety

    INdiana Labor Insider has published a great “end of the year” newsletter. Specifically, there is some very useful information on Space Heater Safety. Do you consistently plug in your space heater directly into the wall, not an extension cord? Take a look at the information below. Be sure that your space heater: Is listed by Underwriters Laboratories or another nationally recognized testing laboratory (Ensures the device meets certain safety requirements), features automatic power-off for tip-overs, temperature control, etc. Read and follow all manufacturers instructions of operation Check space heater prior to use every time (Attachment cord, switches, protective grill cover, etc.) Plug the space heater directly into a wall outlet; Never plug into an extension cord, power strip or surge protector Never run cords under rugs, carpet or other material. OSHA and American Staffing Association form an alliance

During one of the busier seasons of the year, OSHA and the American Staffing Association have formed an alliance to ensure the safety and health of temporary workers. The Department of Labor has issued a video explaining the shared responsibility of host employers and staffing firms in regards to this safety issue. HAZCOM June 1st, 2015 Deadline Was Widely Missed

As of June 1, only about 35% of manufacturers had met the deadline to convert their MSDS’s into the new GHS/SDS  format.   Now, in the 4th quarter of 2015 that number has increased to an estimated 50%- 65%, with a full 100% not being complete until possibly the first quarter of 2016. Click here to see if the June 1st change applies to you.   It is the responsibility of the suppliers to send the revised SDS’s to the employer.  The employer is not required to proactively search for updated SDS’s.  OSHA has said “OSHA would not issue citations for maintenance of MSDS’s when SDS’s have not been received.”  Source of Information provided by M3V.   Want to create and print your own custom labels? OSHA Increases Penalties

Yes, this is really happening! In an effort to catch up on inflation, OSHA will be increasing their penalty amounts. The new two-year bipartisan budget, signed by President Barack Obama on November 2, 2015, requires OSHA to raise its citation penalties. OSHA was one of three federal agencies that were specifically exempted from a 1990 bill that required federal agencies to raise their fines to keep pace with inflation.
